The New York Attorney General has sent a cease and desist letter to the Trump Foundation for allegedly operating without proper certification. The letter dictates that the Donald J. Trump Foundation must “immediately cease soliciting contributions.” AG Eric Schneiderman sent Donald Trump’s charity a notice that he had not acquired proper certification to solicit contributions in New York State and has not been registered with the Charities Bureau. In January, Trump held a veterans event as counterprogramming to a primary debate. He collected $1.67 million in contributinos which were funneled into the Trump Foundation. This is not permitted given the lack of certification in the foundation’s state of origin.
The notice from Schneiderman claims that the Trump Foundation is “is in violation of section 172 of Article 7-A New York’s Executive Law, which requires charitable organizations that solicit contributions in New York State to register with the Charities Bureau and to provide annual financial reports and annual audited financial statements.” A report from The Washington Post detailed the fact that the foundation never properly registered in the state, which became a problem during the veterans event earlier this year. Schneiderman’s investigation of the foundation began with questions about a potentially illegal contribution from the foundation to Attorney General Pam Bondi, for which Trump later paid a fine to the Internal Revenue Service. The foundation was subsequently found to be engaging in what could be construed as self-dealing, in which Trump used money in the foundation to pay personal legal fees.
A lawyer representing Trump did not immediately return a request for comment but campaign spokesperson, Hope Hicks dismissed the letter as being imbued with “political motives.” Nevertheless, she said they’d cooperate with the investigation.
